First, some environmental protection work relaxes requirements and lowers standards. According to relevant requirements, Shanghai Municipal domestic waste should be treated harmlessly in 2015, with a processing capacity of 33400 tons/day. However, the actual processing capacity of Shanghai as of the inspection is only 24000 tons/day, with a large gap, as a result, illegal dumping of garbage occurs frequently, and the problem of illegal disposal of domestic garbage is prominent. In november, 2014, the “notice on strengthening environmental supervision and law enforcement” issued by the general office of the state council requires that all areas should completely clean up illegal construction projects and complete the rectification task before the end of 2016. However, the inspection team checked Pudong New Area, Jinshan district, Songjiang district and other places and found that a large number of illegal and illegal projects were not included in the scope of clearance, only 976 illegal projects of wood processing in Fengcheng town, Fengxian district were not included in the clean-up list. Some projects included in the scope of clean-up have not been rectified. In 2016, 88 of the 259 municipal surface water monitoring sections in the city were inferior to Class V, accounting for 34%. In 2015, the water quality compliance rate of rivers and sections decreased by 30.7% and 20.7% respectively compared with that in 2013. All 16 Assessment sections were inferior to Class V.

However, as of the time of supervision, among the 50 urban sewage treatment plants in Shanghai, there are 10 sewage treatment plants that implement the first-class A discharge standard, accounting for only 4% of the total treatment capacity; there are 21 sewage treatment plants still implementing secondary emission standards, accounting for 68% of the total treatment capacity. In terms of drinking water source protection, shanghai did not include the intake of minhang second water plant and fengxian third water plant in the scope of the first-class protection zone in accordance with the requirements of relevant laws and regulations. There are still more than 100 floating cranes operating illegally for a long time in the drinking water source protection area of the upper reaches of huangpu river, and some floating cranes are located in the first-class drinking water source protection area. There are still 293 illegal and illegal projects and 176 sewage outlets in the secondary water source protection zone of Huangpu River.
The construction of sludge disposal capacity has been slow, and the sludge treatment facilities have not been completed in pudong new area and chongming district as required. The sludge treatment improvement project of shidongkou sewage treatment plant in baoshan district, which should be completed in 2014, has not been completed yet. Part of the sludge is illegally disposed, and the sludge treatment project in Qingpu district has not implemented the environmental assessment requirements, and some heavy metals exceed the standard sludge are composted for landscaping. In addition, 18 urban sewage treatment plants in Shanghai have excessive heavy metals in effluent, and 6 of them have exceeded the standard for a long time.
Third, the law enforcement supervision of relevant departments is soft and weak. The water department in Shanghai has laws that are not followed and the punishment is not strict, which leads to the long-term existence of some industrial enterprises exceeding the standard. According to Shanghai Drainage management regulations, enterprises that seriously exceed the standard should be fined more than 50000 yuan, but among 422 seriously exceed the standard management enterprises that have been punished by the municipal water authority since 2013, there are 375 fines with a minimum penalty of less than 50000 yuan. The environmental protection department is not strict in law enforcement, and the inspection team randomly checks three industrial enterprises and one sewage treatment plant, all of which have problems of long-term illegal sewage discharge but inadequate investigation. The execution of environmental illegal punishment decision is not in place. Some areas have not yet formed an effective mechanism for environmental protection, industry and commerce, water supply, power supply and other departments to cooperate with the People’s Court to implement compulsory measures in non-litigation enforcement cases, as a result, about 800 enterprises in the city that have been ordered to stop production since 2013 have not completed the rectification but still have normal production.
In addition, some key enterprises such as Shanghai Petrochemical and Gaoqiao Petrochemical did not complete the volatile organic compounds management tasks on time. There are 73 hazardous chemicals storage enterprises in Shanghai, 32 of which have not been approved by the environmental impact assessment.
The inspectors demanded that Shanghai should resolutely implement the central requirements, firmly establish new development concepts, high standards and strict requirements, strive to overcome difficulties, promote the green transformation of development mode, and build a more livable ecological city. Accelerate the upgrading of sewage treatment plants, and constantly improve the collection, treatment and supervision system of construction waste, domestic waste and sewage treatment plant sludge. Plus-sized clean up and rectify illegal projects, strengthen environmental law enforcement supervision, and form a joint force of law enforcement. Serious accountability shall be investigated according to laws and regulations. Relevant departments shall be instructed to further investigate the problems found in the inspectors, clarify their responsibilities, and be held seriously accountable according to relevant regulations.
The inspector stressed that the Shanghai Municipal Party Committee and the municipal government should promptly study and formulate the rectification plan according to the “environmental protection supervision plan (Trial)” and the feedback from the inspector, and submit it to the State Council within 30 working days. The rectification plan and the implementation of the rectification should be disclosed to the public in a timely manner in accordance with relevant regulations.
The inspection team also sorted out the problem of investigating the responsibility for ecological environment damage found and will hand it over to the Shanghai Municipal Party Committee and municipal government according to relevant regulations.
